Understanding the Importance of Casino Laws and Regulations

The Internet age brought with it the launch of online gambling, which rapidly expanded and initially took governments by surprise.

This early phase of online gambling lacked regulation. This exposed players to risks such as unfair practices, fraud, and limited legal dispute resolution options.

Governments worldwide have since stepped in to regulate online gambling, introducing various laws and acts to protect consumers playing at reputable online casinos.

Remember

Online gambling laws can change over time.

Key Milestones in the Development of Online Gambling Legislation

Let's quickly go over some of the most significant endeavors that helped shape the online gaming industry:

Year Event Impact
1961 The US Congress passed the Interstate Wire Act Prohibited US companies from using wire communication technology for processing sports bets
1994 The Antigua and Barbuda government enacted the Free Trade & Processing Act Allowed issuance of licenses for internet-based casino operations
1996 The Kahnawake Gaming Commission was established in Canada Pioneered a framework for regulating and licensing online gaming
1998 USA unsuccessfully attempted to introduce the Internet Gambling Prohibition Act to ban online gambling Showed that governments were reluctant to legalize this type of entertainment
2001 Australia passed the Interactive Gambling Act (IGA) Banned Australians from online gambling
2005 The UK enacted the Gambling Act 2005 Legalized and regulated online gambling in the UK
2006 USA introduced the Unlawful Internet Gambling Enforcement Act Processing transactions for online gambling became illegal
2010-2011 Various countries and states have legalized online gambling, including France, Spain, and Italy. The need for regulation for player protection was recognized on a global scale
2018 USA repealed the Professional and Amateur Sports Protection Act (PASPA) Online sports betting was legalized in the USA

Variations in Online Casino Regulations

The regulation of different gambling types, such as sports betting, poker, and online slots, varies across jurisdictions. Some allow certain forms while restricting or prohibiting others.

How Do Regulations Apply to Online Casinos?

A casino website is legal if it holds a legitimate gambling license issued by a regulatory authority.

To obtain a license, a casino must demonstrate full compliance with local iGaming regulations, including measures to ensure player protection and fair gaming.

Keep in mind

The most relevant license that a casino can obtain is the one from the regulatory body overseeing online gambling in the area where the casino operates.

Taxes & Fees

Casino operators must pay taxes on their gaming revenue and licensing fees.

Social Casinos

The regulations governing online casinos do not necessarily extend to cover social casinos.

Since social casinos operate using virtual currency instead of real money, they are subject to less stringent regulations and enjoy wider global acceptance.

The Importance of an Age Limit

Regulators set age limits to safeguard young individuals who may not fully grasp the risks of gambling or know how to play responsibly.

Exceptions

Casino websites can set age restrictions that are stricter than the official minimum set by the country or state.

For instance, some casinos in Portugal only accept individuals over 25, whereas others accept 18-year-olds.

Why Is Gambling Restricted or Illegal in Some Areas?

In places like Utah, Hawaii, Russia, Australia, and Alaska, most or all forms of online gambling are illegal due to moral, ethical, or regulatory reasons:

  • Moral & cultural viewpoints: gambling can be considered immoral or inconsistent with local cultural, religious, or moral values.
  • Ethical & social considerations: there are concerns related to problems arising from gambling, such as addiction and the societal impact it may have.
  • Brick-and-mortar sector protection: certain governments aim to protect traditional casino businesses and their revenue.
  • Lack of a regulatory framework: some areas don’t have local rules in place to ensure it's fair and safe to gamble online.

Offshore Gambling

Some regions allow citizens to play at a gambling platform licensed by a foreign regulatory authority.

Why Should I Care About Online Gambling Laws?

Simply put, casino regulations help protect your interests as a player and provide a fair gaming experience.

When you play in regulated casinos (aka licensed casinos), you can enjoy several benefits that can improve your gameplay experience:

Your Information Stays Safe

Regulated casinos use high-level security measures to safeguard your personal and financial data.

This means you can enjoy your games without worrying about your sensitive information falling into the wrong hands.

Fraud Ain't a Thing In Licensed Casinos

Licensed casinos adhere to strict anti-money laundering rules and security protocols, ensuring the safety of your funds.

Moreover, according to casino laws and regulations, every regulated website is required to keep player funds in separate bank accounts, different from the casino's operational funds. Hence, should the casino website ever file for bankruptcy, all players will be able to get their money back.

Fair and Square Games

The game outcomes are fair, and nobody can tamper with them. Cheating and any other fraudulent activities are prohibited so that you can have the same winning chances as the rest of the players.

Furthermore, licensed casinos have their games checked for fairness and randomness by reputable agencies, such as eCOGRA and iTech Labs.

Staying in Control is Easier

These casinos provide you with resources to maintain a healthy approach to gambling and prevent gambling addiction, such as:

  • Self-limits for your bets and deposits.
  • The option to take a break from gambling and self-exclude.
  • Links to pages where you find resources and help for problem gambling.
  • Contacts for organizations assisting those struggling with gambling issues.

What You See Is What You Get

Regulated casinos must be transparent about their terms and conditions and cannot use deceptive advertising.

Hence, you can play relaxedly knowing that games, bonuses, payments, and everything else, function as described in the T&C.

Author Note

Many users around the world just tick the box "I agree with the T&C", sadly, myself included sometimes.

However daunting it may seem, it's very much worth your time to always check the T&C of each casino, to know what you are signing up for. This keeps you away from any unpleasantries later down the line, such as not being able to withdraw your winnings because you unknowingly breached the terms.

Assured Payouts

When you win, you can be confident you'll get your winnings. Regulated casino websites must have funds readily available to pay out their players.

A Helping Hand When You Need It

Suppose you ever face issues or disputes with the casino or notice it is conducting illegal activities. In that case, you have the backing of an Approved Alternative Dispute Resolution (ADR) entity.

The ADR will review your case and provide a fair and final decision.

Warning

If you play at an unregulated casino, the official organization overseeing gambling in your jurisdiction has no authority to pursue a dispute with it. Thus, you are on your own.

Also, it's illegal for you to play there, and can face legal consequences (more on that, in a later section on the page).

Software Licensing

It's also vital that the software providers supplying the games to casinos also hold valid licenses.

This dual licensing ensures fairness, player data security, and regulatory compliance throughout your gaming experience.

Note

Among the big brands that hold many gambling licenses, including those from the UKGC and MGA, are NetEnt, Play'n GO, and Games Global.

Who Regulates Online Gambling?

There isn't one organization regulating gambling worldwide, nor a universal gambling law applicable in all countries and continents.

Each government appoints its own local official regulatory authority to oversee online gambling.

Regulators' Key Responsibilities

Regulators establish their specific regulatory framework for their jurisdiction, provided it aligns with the relevant national or regional laws.
Moreover, these authorities issue casino and software licenses, conduct inspections, and monitor casino operations.

Cross-border Licensing

Some regulatory authorities (e.g., Curaçao eGaming) can license casinos beyond their local jurisdiction.

Hence, gambling laws vary worldwide, with some places having relaxed regulations and others imposing strict prohibitions.

Unregulated Markets

In certain countries, online gambling is neither regulated nor illegal. It's a bit of a grey zone there. This is especially prevalent in African countries.
Keep in mind that the absence of casino laws and regulations comes with risks for players.

Warning

It's crucial to understand and follow your area's specific casino laws and regulations to make sure you can play legally.

In the next section, we’ll examine who regulates online gambling across different areas.

Europe

Each EU country is free to establish its own regulatory framework. However, it must adhere to the Treaty on the Functioning of the European Union (TFEU) and follow guidelines from the European Gaming and Betting Association (EGBA).

  • Isle of Man Gambling Supervision Commission.

These authorities set high standards for licensing, making casinos holding their licenses widely regarded as more trustworthy than others.

Canada

Online gambling is legal in Canada, but federal laws on it are not very defined.

While the Criminal Code of Canada does touch upon gambling issues, the regulation of online gambling is primarily the responsibility of individual provinces.

Do You Know About The Chipy Council?

We have a system through which we assess which casinos we find to be the most reliable. When a casino passes our strict requirements, we give it our Chipy Token of Trust.

It's our way of "licensing it," so to speak.

Checking Whether a Casino Holds a License

Now that we’ve established how important a valid gambling license is, let’s review how to verify whether a casino holds one.

The easiest method is to check our casino review page. We keep it up to date with the latest accurate information.

Another way to do it is to visit a casino’s official website and check its footer, About Us, or Legal page.

Look for details such as the name of the licensing authority, license number, and period of availability (issue and expiry date).

In most cases, a link to the license document is available.

If you need help finding the licensing information on the casino's website or have doubts about its authenticity, contact the casino's customer support and ask for information.

Watch out

While gambling may be regulated and permitted in your area, it's important to note that not all casinos operating there hold proper licenses.

Verifying the Legitimacy of a Casino License

Mere claims of a casino holding a license are insufficient proof of its legitimacy.

Warning

Dishonest casinos might make misleading claims about their licensing and use fake information to give players the impression that they are operating within the bounds of the law.

Thankfully, gambling authorities readily share accurate and up-to-date licensee information on their official websites.

  • Search by name

Depending on the licensing authority, they usually have a search function or a list of licensed operators on their official website.

You can use either to search for the specific casino and confirm its licensing status.

Example

For instance, to confirm a UKGC license, visit the Public and Players page on the Gambling Commission website and input the casino's name under "Check a gambling business license."

  • Search by license number

Another method to authenticate a license is to cross-reference the license number (if the casino provides one) with the licensing authority's database.

Author's Note

I find this method quite tedious.

When I want to verify a license, I prefer to either check our casino reviews page, or directly verify the specific casino's footer section.

What About Online Casino Regulation While Abroad?

When traveling abroad, your home country’s gambling laws and regulations no longer apply.

Instead, the gambling laws of the state or country you visit do. Plus, you have to consider the rules regarding foreigners gambling there.

You need to gather info on the gambling laws and regulations in the destination country to avoid legal problems. Here are some top things that you need to know:

Multiple Licenses

A European casino may need to obtain multiple licenses from different jurisdictions before it can legally provide its services to players across various countries or regions within Europe.

Jurisdiction-specific Rules

Certain regions impose their unique regulations. While they may not explicitly prohibit online gambling for foreigners within their borders, these rules often entail criteria only residents can fulfill.

For example, you need a Swedish social security number to gamble at licensed online casinos in Sweden.

Foreigner Laws May Differ

Besides its state and province having its own gambling laws, it also has its own laws for foreigners.

For instance, although the legal gambling age for residents in Portugal is either 18 or 25 (depending on the casino), foreigners can legally gamble at the age of 18.

Financial Impact

You may encounter currency exchange and international transaction fees when you gamble in a different country.

Additionally, it's essential to consider that the local economic conditions can influence the betting requirements. The minimum bets can be set higher than in your home country. You might have to make bigger wagers than you're typically comfortable with.

Also, you could have to pay taxes on winnings in both the country you're visiting and your home country. Yikes!

A Risky Combination

The excitement of exploring new places combined with the allure of gambling can increase the chances of excessive gambling, so be cautious and pay attention to your habits.

Bypassing Location Checks

Considering the potential downsides of gambling abroad, you might have thought about using a tool to change your location.

However, this is a "sounds good, doesn't work" case. I'll elaborate on this in a later section.

Player Obligations

Casinos and the organizations overseeing their activity attempt to protect your rights, but you have to do your part, too:

What You Must Do How It Helps You
Declare your casino winnings to tax authorities and pay taxes on them

Guarantees compliance with local tax laws, preventing legal issues

Maintains transparency in your financial records

Establishes the legitimacy of your income

Complete the identity verification process Protects you from identity theft and fraud
Verify your payment methods and sources of money     Helps prevent money laundering, fraud, and unauthorized use of your financial details
Carefully read & adhere to the casino’s terms and conditions.

Provides you with a fair and transparent gaming experience

Prevents misunderstandings between you and the casino

Play fairly and refrain from participating in any cheating or fraudulent actions.

Maintains the integrity of your games

Ensures that you have the same fair chance of winning as the rest of the players

Keeps you away from legal issues

Report any issues you encounter ASAP to customer support

Provides you with quick issue resolution and lets you resume your gameplay promptly

Prevents further complications, such as games not paying due to errors

Carefully protect your login credentials, and do not share them with anybody else

Prevents unauthorized access to your account

Protects your funds and personal data from potential breaches

Be respectful towards customer support and other players Fosters a positive gaming environment for everybody

If You Don’t Play By The Rules

It's important to be aware of your responsibilities as a player, as not following them could result in certain consequences. These will depend on the specific situation and can include:

  • Temporary account suspensions.
  • Permanent bans.
  • Loss of winnings.
  • Legal consequences.

The Purpose of Taxes

By complying with tax regulations, the gambling industry remains a responsible contributor to society.

Getting Around Online Gambling Laws: Neat Trick or Fool’s Errand?

Given the stringent regulations in some places, some individuals might find them upsetting.

They try to look for ways to get around online gambling regulations, such as using tools to change their device’s location.

If the idea appeals to you, hear me out, please.

Online gambling rules and regulations are put in place to protect you. If you engage in illegal gambling, your financial and private information are at risk, first of all.

Secondly, you will get caught sooner or later and suffer legal consequences.

And you won’t be able to withdraw and keep your winnings, so there’s no use in trying this in the first place.

Personal Experience

Before I learned about the concept of casino regulation, I simply chose casino websites based on their game selection and bonuses.

It cost me some hundred dollars to realize the casinos were not licensed and did not pay out any winnings.

Additionally, I continued to receive spam messages on the email address I used during the registration process to this day. Don't be like me.

What Is the Punishment for Illegal Gambling?

Illegal gambling can have drastic consequences that leave a lasting mark on your criminal record, as well as your personal and professional life.

Some jurisdictions treat it as a misdemeanor offense, whereas others consider it a felony.

Depending on your jurisdiction's laws and the severity of your offense, you might:

  • Pay fines.
  • Go on probation.
  • Do jail time (up to a few years in strict jurisdictions).
  • Be subject to asset forfeiture: authorities may seize any assets, including money, that you obtained using illegal gambling operations.
  • Perform community service.
  • Receive a charge on your criminal record, which could significantly impact your career and personal life, such as hindering job opportunities and loan eligibility.

Staying on the Right Track

If you want to gamble in a place where it's against the law, or you're seeking more excitement but are unsure if legal options can provide it, please take a moment to reflect.

Consider reaching out to an anonymous gambling helpline to explore the underlying reasons behind these urges so that you can take back control of your life and not do something you will regret later on.

The Future Of iGaming Regulations and Rules

Considering all of the above, it begs the question: what does the future hold for iGaming?

To answer that, we need to keep in mind that technological advancements have been at an all-time high in the past decade.

Governments have to figure out how to respond to them, protect consumers, and prevent gambling-related harm in the future.

Hence, the laws on online gambling will change and likely be more strict.

Technology Advancements & Their Uses

By the looks of it, in my opinion, the future of iGaming will likely be shaped by:

  • Mobile gaming replacing desktop gambling.
  • The implementation of Artificial Intelligence (AI) programs.
  • The growing usage of Virtual Reality (VR) and Augmented Reality (AR) systems.
  • The wider use of cryptocurrency payments.

Let's quickly go over them and see how they can influence the gambling experience:

Mobile Gaming

Before the internet, gambling was only possible at specific places and times.

In mobile online casinos, you can basically play anytime, from anywhere. The temptation is always within reach, making it harder to gamble responsibly than when gambling on a desktop device.

Just think about how people wagered a record $1.6 billion when gambling on mobile devices in the first month since sports gambling became legal in New York!

Artificial Intelligence (AI)

Given the rapid advancement of AI programs lately, licensed casinos could be required to use AI algorithms for tasks like:

  • Monitoring game outcomes to ensure they are random and unbiased.
  • Detecting irregular patterns that might indicate cheating or fraudulent activities.
  • Identifying early signs of problem gambling in players and helping to prevent them from developing unhealthy habits.

Virtual Reality (VR) and Augmented Reality (AR)

VR and AR technologies offer immersive gaming experiences, which sounds good, right?

The other facet is that they raise concerns about user safety and the psychological impacts of hyper-realistic gambling environments. Problem gambling could become more prevalent.

Cryptocurrency Payments

Crypto platforms offer flexibility, convenience, and faster payouts.

However, as crypto becomes more widely accepted, it introduces challenges for regulators to issue casino laws through which they can detect and prevent anti-money laundering (AML).

Organizations Shaping Online Casino Regulation

Apart from official regulatory bodies, other platforms also address the issue of online gambling regulation. These focus on improving how gambling is regulated, establishing internationally consistent rules, and devising strategies to adapt to emerging technologies.

The Tide is Shifting

The Dutch court set a groundbreaking precedent in 2023. It offered protection to players who gambled at unlicensed casinos and held the online gambling providers responsible for knowingly allowing them to engage in illegal gambling.

Wrapping Up

Playing at regulated and licensed casinos provides invaluable peace of mind that your games are fair and your data is safe.

I don't think iGaming regulations and laws are perfect right now. Still, they are getting better through ongoing discussions between regulators.

Still, though I am excited to see what the future brings regarding iGaming experiences, I sometimes doubt the regulators' abilities to adapt in time to the rapidly advancing technological landscape.

All we can do for now is stay updated with the latest casino law changes in our jurisdictions and play responsibly at regulated casinos.
